Health Care Proxies

A health care proxy is a legal document that allows a person to appoint an agent to make healthcare decisions on behalf of the patient, when he or she is incapable of making and executing the healthcare decisions set forth in the proxy.

The New York State Department of Health advises that everyone over the age of 18 should appoint a health care agent for medical treatment.  Certain information—such as medical records—may not be readily available to an assigned health care agent if that agent is not a doctor.  And other complex situations may arise that call for an attorney’s attention when a Health Care Proxy is executed.
